Tenancy Contract in Dubai

The Chairman of the Dubai Rent Committee,
Saeed Al Ghundi has requested the tenants
to read the contract thoroughly before
signing them to ensure that no additional
clauses are introduced, as in case of
any disputes, the rent committee will
have to take a decision based on the tenancy
contract.

For instance, in case the tenancy
contract states that the tenant will have
to vacate the house after a certain period,
the tenant will be left with no other
option except to vacate the house. However,
Al Ghundi mentioned that tenants should
refuse to sign a contract that carries
such a clause.

Al Ghundi clarified that other than
the seven percent hike, the landlords
are not permitted to introduce any new
changes, and in case there is a new clause,
the tenant is permitted to refuse such
a deal. In case of any disputes, the parties
can approach the rent committee, but the
person who lodges the complaint should
pay 3.5 percent of the annual rent, as
fee to the rent committee, and the losing
party will have to bear the expense.
For any dispute with the landlord you
can make your claim to the Dubai rent
commitee who will ear your claim and request
the landlord to respond . Between that
time you will be under the surveillance
of the commitee the time the settelment
is made. But before you made the claim
the law stipulate that you must register
your contract with the RERA.

The Dubai Tenancy Law (No. 26 of 2007)
mandates the registration of all tenancy
contracts with Rera. The law, which came
into effect on February 29, also requires
judicial bodies and government departments
not to consider any claim, case or execution
that is based on an unregistered tenancy
contract.

No fees are charged for registering tenancy
contracts at the moment, according to
Mubarak Mohammad Bel Jafla, Head of Registration
and Compliance Department, Rera. "We
do register tenancy contracts now, especially
for those who need to open a case with
the municipality’s Rent Committee,"
said Bel Jafla.

It’s a three-minute registration
procedure per contract: filling in the
names of the tenant and landlord, contact
numbers, property address, contract period,
rental amount and payment mode, Bel Jafla
explained.
Meanwhile, a senior official at the Dubai
Municipality’s Rent Committee also
stressed they would only entertain Rera-registered
contracts.
Mohammad Al Shaikh, General Secretary
of the committee, said: "Whoever
wants to complain or open a case with
us must register the contract with Rera.
We won’t accept any case or complaint
or dispute based on an unregistered contract."
Registration of tenancy contracts may
allow Rera to draw up the average rent
based on thousands of contracts with similar
properties in specific areas.
The authority may also calculate a fair
rent value, using best international practice.
The new law may further prevent landlords
from increasing rents, or amending conditions
within the first two years.
A customer service staff at the Dubai
Electricity and Water Authority (DEWA)
said it would continue to register tenancy
contracts to calculate and collect the
housing fee.
